1. Introduction
- “Inqlha” refers to the digital platform, website, and mobile application operated by [Company Legal Name].
- “User” / “Customer” means any individual or business booking services through Inqlha.
- “Driver” means any registered and verified individual offering moving or delivery services through Inqlha.
- “Fleet Owner” means any verified individual or company that registers and manages multiple vehicles and drivers on the Inqlha platform.
- “Service Provider” collectively refers to Drivers and Fleet Owners.
- “Services” refers to transportation, moving, logistics, and related offerings available on the platform.
2. Use of the Platform
- Users must be at least 18 years old to create an account and use the services.
- All information provided during registration must be accurate, complete, and up to date.
- Users are responsible for maintaining the confidentiality of their account login credentials.
- Fleet Owners are responsible for ensuring that all registered vehicles and drivers under their account meet Inqlha’s requirements and comply with Saudi law.
3. Services Provided
- Inqlha acts as a digital marketplace connecting Customers with verified Drivers and Fleet Owners.
- Inqlha itself does not own vehicles or directly provide transportation services.
- Customers are responsible for ensuring their goods are legally permitted for transport.
4. Pricing & Payments
- All service prices are displayed upfront through the platform with transparent pricing and no hidden fees.
- Customers may pay:
- Cash directly to the Driver/Fleet Owner (when applicable).
- In-app digital payment, which is transferred to the Driver’s or Fleet Owner’s Inqlha Wallet.
- Drivers and Fleet Owners subscribed to Inqlha may pay a subscription fee for unlimited access to trip requests.
- If not subscribed, a 1.5% service fee applies before submitting a quotation. • Any requested refunds will be handled according to Inqlha’s Refund Policy.
5. Delivery Notes & Tracking
- Customers receive real-time tracking for each booking.
- Delivery notes are generated and stored digitally within the app for instant download.
- Inqlha is not responsible for delays caused by traffic, weather, or other unforeseen conditions outside the Service Provider’s control.
6. Responsibilities of Drivers & Fleet Owners
- Drivers and Fleet Owners must maintain valid licenses, permits, and insurance as required by Saudi law.
- Fleet Owners are responsible for the conduct, compliance, and performance of all drivers operating under their account.
- Vehicles must be safe, roadworthy, and suitable for the assigned tasks.
- Service Providers must follow ethical practices and maintain professional conduct at all times.
7. Limitation of Liability
- Inqlha is a platform and is not directly responsible for damages, loss, or theft of goods during transportation.
- Claims related to service quality should be addressed first between the Customer and the Service Provider. Inqlha may mediate disputes but does not guarantee outcomes.
8. Cancellation & Refund Policy
- Customers may cancel bookings within the timeframe stated in the app.
- Cancellation fees may apply depending on the stage of the booking.
9. Privacy & Data
- Inqlha values user privacy and follows applicable Saudi and international data protection laws.
- Personal information will not be shared with third parties without consent, except as required by law.
10. Modifications to Terms
- Inqlha reserves the right to update or amend these Terms & Conditions at any time.
- Continued use of the platform after changes indicates acceptance of the updated Terms.
11. Governing Law
- These Terms & Conditions are governed by the laws of the Kingdom of Saudi Arabia.
- Any disputes shall be subject to the jurisdiction of courts in Saudi Arabia.
